File a trade mark application

If you have decided which sign you want to register and you have prepared a list of goods and services, proceed to filling in the application form itself.

The application can only cover one sign. On the date of acceptance of the application by the Office, the applicant acquires a right of priority over anyone who later files an application containing an identical or similar sign for identical or similar goods or services. If you have filed an identical application for an identical list of goods and services in a State which is a party to the Paris Convention for the Protection of Industrial Property or a member of the World Trade Organisation within a period of not more than six months prior to the filing of the application with the Office, you may claim priority from the first application for that trade mark. The right of priority must be proved by proof of priority within three months of the filing of the application with the Office.

Electronic filing is subject to a 50% discount on the administrative fee, up to a maximum of € 70.

Upon successful filing of the trade mark application, the Office will ask you to pay the administrative fee together with the payment identification details. The administrative fees are payable within 15 days from the date of receipt of the written invitation from the Office. Electronic filing of trade mark applications is subject to a 50% discount on the administrative fee, up to a maximum of € 70.

The length of the procedure depends to a large extent on the quality of the preparation of the application and the speed of payment of the administrative fee. If the application for registration in the trade mark register is filed electronically, the list of goods and services is drawn up using the ezts tool (https://www.ezts.sk) and the fee is paid within three working days from the date of dispatch of the acknowledgement of filing, the examination of the application, including its publication, is carried out within 30 working days from the date of filing, provided, of course, that no formal or substantive defects in the application have been pointed out to the examiner.
